Please read these Terms & Conditions (the Terms) carefully. They explain the rules that apply when you access this website, submit an order to Arts & Crafts, or otherwise use services that link to these Terms. If you do not agree, do not use the website or place a direct order.

Nothing in these Terms limits rights or remedies that cannot legally be excluded under applicable federal, provincial, territorial, state, or local consumer-protection law.

Agreement and business identity

These Terms form an agreement between you and Anavrin Digital Services Inc., operator of the Arts & Crafts brand (Arts & Crafts, we, us, or our). Our business address is 16-2354 Major Mackenzie Dr, Suite 210, Vaughan, Ontario, Canada L6A 1W2.

By using the website or placing a direct order, you confirm that you have read and agree to these Terms, our Privacy Policy, and any policies or product instructions expressly incorporated by reference.

Eligibility

You must be at least the age of majority in your province, territory, or state to place an order. If you permit a minor to use a product, you are responsible for appropriate adult supervision and for following all product-specific directions and safety information.

You may use the website on behalf of a business only if you have authority to bind that business to these Terms.

Website and sales channels

These Terms apply to consumer and wholesale purchases completed directly through this website. A written wholesale quote, purchase order acceptance, or account agreement may add order-specific terms; if there is a conflict, the more specific written term applies to that wholesale order. Arts & Crafts products may also be offered through Amazon or other approved marketplaces. If you purchase from a marketplace, the marketplace or fulfilling seller may be the seller of record, and its payment, shipping, cancellation, return, and privacy terms also apply.

Direct website ordering is not available for delivery addresses in Quebec. Customers in Quebec may purchase Arts & Crafts products through Amazon or another approved marketplace that offers delivery to their address. That marketplace's terms and policies apply to the purchase.

Information on this website may help you compare products sold through different channels, but an order is governed by the terms shown in the channel where you complete the purchase.

Products and information

We work to present product names, ingredients, sizes, colours, images, features, compatibility information, safety documents, and instructions accurately. Because soap bases are manufactured materials and website displays vary, colour, clarity, texture, packaging, and other non-material characteristics may differ slightly between images, batches, and delivered products.

The product listing, packaging, lot information, and current Safety Data Sheet or other product-specific document, where provided, take priority over general educational content. We may correct typographical errors, inaccuracies, or omissions and update product information without notice.

Arts & Crafts markets these bases as cosmetic soap products intended for soap making and cleansing after preparation. They are not represented as drugs, natural health products, disinfectants, or treatments for any disease or medical condition. Where a Canadian-origin claim is used, it means made and packed in Canada with domestic and imported ingredients.

Availability is not guaranteed. We may change or discontinue a product, package, specification, purchasing channel, or offer at any time, subject to our obligations for orders already accepted.

Safe and lawful product use

Soap bases and soap-making supplies must be stored, handled, heated, formulated, labelled, and used according to the product page, packaging, safety documentation, and other instructions supplied with the product. Melted soap and heating containers can cause burns. Use appropriate equipment, ventilation, protective measures, and adult supervision.

Our guides are general educational information, not medical, dermatological, regulatory, or professional formulation advice. Do not use a product if you are allergic or sensitive to an ingredient. Stop use and seek appropriate medical advice if irritation or another adverse reaction occurs.

If you use our products to make goods for sale, you are solely responsible for your finished formulation and for all testing, manufacturing, labelling, claims, registrations, records, and other requirements that apply where you make and sell those goods. You may not represent that Arts & Crafts has tested, approved, certified, or endorsed your finished product unless we have agreed in writing.

Orders and acceptance

Your order is an offer to purchase. An automated acknowledgement confirms that we received the order; it does not necessarily mean we have accepted it. A contract for a direct purchase is formed when we send an acceptance or shipment confirmation, or otherwise begin fulfilling the order.

We may decline or cancel an order before acceptance for reasons such as inventory shortages, pricing or description errors, payment or fraud concerns, suspected resale abuse, legal restrictions, quantity limits, or inability to deliver to the address provided. If we cancel after payment has been authorized or collected, we will void the authorization or refund the affected amount.

You are responsible for providing complete and accurate billing, delivery, and contact information. Please review an order carefully before submitting it and contact us promptly if you identify an error.

Prices, currency and taxes

Prices and available currencies will be shown on the website and confirmed before checkout. Unless stated otherwise, product prices exclude applicable sales taxes and delivery charges. Amounts payable through our direct checkout will be disclosed before you submit the order.

For ordinary consumer direct orders, any applicable duties and brokerage fees will be included in the amount shown at checkout or handled by Arts & Crafts, so you are not expected to pay a separate charge upon delivery. A bulk, wholesale, pallet, or special-order quote may assign responsibility for duties, brokerage, taxes, and related import charges; those terms will be disclosed before the order is accepted.

Canadian and U.S. pricing may differ because of currency, tax, shipping, promotional, or market factors. A price displayed on a marketplace may also differ from our direct price. We do not guarantee price matching between channels.

If a material pricing error is discovered before acceptance, we may cancel the affected item and notify you. We will not charge a higher corrected price without your agreement.

Payment

Direct website payments will be processed through Shopify Payments or another payment method displayed through Shopify checkout. You authorize us, Shopify, and the applicable payment provider to charge the total shown at checkout, including applicable taxes and delivery charges. You represent that you are authorized to use the selected payment method.

Marketplace purchases are processed by the applicable marketplace or its payment provider. We do not control a payment provider's separate terms, identity-verification process, authorization holds, exchange rates, or fees. A provider may decline a transaction under its own rules.

Shipping and delivery

We currently intend to offer direct delivery to eligible addresses in Canadian provinces and territories outside Quebec and in the United States. Direct consumer orders are processed and released for shipment within three business days after we receive a complete order, unless a different timeframe is disclosed before checkout. A written quote or order confirmation may specify a different processing time for a bulk, wholesale, pallet, or special order.

Orders may be fulfilled by Arts & Crafts or an authorized fulfilment partner. We may select the shipping facility, origin, carrier, and service based on cost, availability, destination, order size, service reliability, and delivery requirements.

Available services, charges, estimated timing, and restrictions will be shown before checkout. Deliveries to Alaska, Hawaii, Canadian territories, U.S. territories, PO boxes, and military addresses may require a different service or additional shipping charge. Any additional charge will be shown at checkout or confirmed with you before we accept the order. If an eligible service is unavailable or you do not accept the additional charge, we may decline or cancel the order and issue a full refund.

If we cannot ship within the timeframe stated for the order, we will notify you before that timeframe expires, provide a revised shipment date when available, and offer the choice to accept the delay or cancel the unshipped order for a full refund. Delivery dates are estimates unless we expressly agree otherwise in writing.

Risk of loss and title pass as required by applicable law and the shipping terms shown at checkout. Please inspect your order promptly. You are responsible for supplying an accurate, secure, and serviceable delivery address and for import charges expressly assigned to you in an accepted bulk, wholesale, pallet, or special-order quote.

Returns, refunds and order issues

For direct orders, a return must be requested within 30 calendar days of recorded delivery. The product must remain unused, unopened, unaltered, and in its complete original packaging. A soap base is final sale after it has been opened, cut, melted, mixed, customized, or otherwise altered, except where applicable law requires otherwise.

For an eligible voluntary return, you are responsible for return-shipping costs and original shipping charges are not refundable. There is no restocking fee for an ordinary eligible consumer return. An order identified as a bulk, pallet, wholesale, or special order at checkout or in a written quote may be subject to a 25% restocking fee.

Transit damage, fulfilment errors, and apparent qualifying product-quality concerns must be reported through our Support page within three business days of recorded delivery. If we confirm a qualifying issue and require a return, we will cover the authorized return-shipping cost. Approved refunds are processed within 10 business days after receipt and inspection. You may request cancellation of a direct order before it is accepted by the carrier. If fulfilment or packaging has already begun, we may deduct only the actual payment-processing fee that our processor does not refund, never more than 5% of the order total, where permitted by law and disclosed before checkout. No deduction applies when we cancel the order, when the cancellation results from our error, or when a statutory cancellation or refund right applies. Once the carrier has accepted the shipment, the request is handled as a return rather than a cancellation.

For a marketplace order, contact the marketplace or fulfilling seller through the order record. Its cancellation, return, and refund rules apply. For a direct order, contact us promptly about damaged, missing, or incorrect items, or an unopened product with a compromised seal, visible contamination, or another apparent condition that materially prevents it from being used as described. Retain the product, packaging, lot information, and photographs reasonably needed to review the issue.

Communications

We may send service messages needed to process an order, respond to a request, provide safety or recall information, or administer your direct relationship with us. Service messages may continue where they are necessary to provide a requested service or meet a legal obligation.

If we offer an optional newsletter, promotional email, or SMS marketing program, we will send marketing communications only as permitted by law and will provide the applicable unsubscribe or withdrawal method. Our use of contact information is further explained in the Privacy Policy.

Acceptable website use

You may use the website only for lawful personal or business purposes consistent with these Terms. You must not interfere with the website, bypass access or security controls, introduce malicious code, scrape or copy substantial portions of the website without permission, misuse another person's information, impersonate another person, submit false reviews or requests, or use the website to violate law or another person's rights.

We may restrict or suspend access where reasonably necessary to protect the website, customers, our rights, or third parties, or to comply with law.

Intellectual property

The website and its original text, graphics, photographs, illustrations, product presentation, logos, trade names, layout, code, downloads, and other content are owned by or licensed to Arts & Crafts and are protected by applicable intellectual-property laws.

Arts & Crafts and associated brand elements are used as trademarks. No website use or product purchase grants permission to use our trademarks, branding, or confusingly similar marks.

We grant you a limited, revocable, non-exclusive, non-transferable right to access the website for its intended purpose. No other right is granted. You may not reproduce, modify, distribute, sell, license, or create derivative commercial materials from our content without prior written permission, except where law permits otherwise.

Third-party services and links

The website may link to Shopify services, payment processors, carriers, Amazon, other marketplaces, social platforms, document hosts, or other third parties. A link is provided for convenience and does not mean we control or endorse every third-party service or its content. Your use of a third-party service is governed by its own terms and privacy policy.

Warranties and disclaimers

We will provide products and services with the warranties and standards required by applicable law. Except for those non-waivable obligations and any express written product warranty, the website, educational content, and services are provided on an "as available" basis. We do not promise that the website will always be uninterrupted, error-free, or suitable for every formulation or commercial purpose.

To the fullest extent permitted by law, we disclaim implied warranties that may legally be excluded. This clause does not exclude implied conditions, statutory warranties, guarantees, or remedies that cannot be waived under Canadian or U.S. consumer-protection law.

Limitation of liability

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence where such liability cannot be excluded, or any other liability or consumer remedy that law does not allow us to limit.

Subject to the paragraph above, and to the fullest extent permitted by law, Arts & Crafts will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss; loss of profit, revenue, goodwill, data, or business opportunity; or loss resulting from an unauthorized or improper formulation, label, claim, resale, storage, heating method, or use of a product.

For a claim connected with a direct order, our aggregate liability will not exceed the amount paid for the product giving rise to the claim, unless applicable law requires a greater remedy. Some jurisdictions do not permit certain exclusions or limits, so part or all of this section may not apply to you.

Indemnity

To the extent permitted by law, if you use our products in a commercial finished product, you agree to defend, indemnify, and hold Arts & Crafts harmless from third-party claims, losses, and reasonable costs arising from your formulation, manufacturing, testing, marketing claims, labelling, sale, or regulatory non-compliance, except to the extent caused by our breach, negligence, or unlawful conduct.

This section applies only when a business or other commercial buyer uses a base in a finished product that it manufactures, markets, distributes, or sells. It does not apply to ordinary consumer use and does not remove any non-waivable consumer right.

Privacy

Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information, and describes privacy choices and rights that may be available to you.

Governing law and disputes

Before filing a formal claim, please contact us and provide enough information for both sides to try to resolve the matter in good faith. Nothing in this section prevents either party from seeking urgent injunctive relief or using a small-claims or consumer-protection process that is available by law.

These Terms and any dispute relating to them or a direct order are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles. Subject to any non-waivable consumer right to bring a claim elsewhere, the courts located in Ontario will have jurisdiction.

We do not require mandatory private arbitration. Either party may propose voluntary mediation, but neither party is required to accept it. You keep the protection of mandatory consumer laws that apply in your province, territory, or state of residence.

General terms

Changes

We may update these Terms prospectively when our services, practices, or legal obligations change. We will post the updated version and revise the last-updated date. Terms in effect when a direct order is accepted continue to govern that order unless law requires otherwise.

Severability and no waiver

If a provision is found unenforceable, it will be enforced to the maximum extent permitted or removed while the remaining provisions continue. A delay in enforcing a right is not a waiver of that right.

Assignment and entire agreement

You may not transfer your rights or obligations under these Terms without our consent. We may transfer them in connection with a merger, financing, sale, reorganization, or transfer of our business, subject to applicable law. These Terms and policies incorporated by reference form the entire agreement about the website and direct orders, except for any express written agreement between you and us.
